Photo and Digital Consent Policy
Purpose
The Children’s Rights Alliance Inc. trading as Children’s Rights Queensland (CRQ) is committed to respecting and protecting the privacy and rights of children when using photographs, videos, and other digital media. This policy defines the procedures for obtaining consent for capturing and utilising images of children at CRQ events, programs or in CRQ’s publications, materials, and platforms.
Commencement
This policy takes effect from 1 July 2025 and supersedes all previous policies, whether documented or not.
Scope
This policy applies to:
- Leadership Team
- Executive
- Employees, contractors and volunteers
- Partners
- Members of the public including children and those attending CRQ events or activities
Definitions
- Consent: The explicit or implied agreement from a parent/guardian (and, where appropriate, a child) to allow photographs or videos to be taken and used by CRQ for specified purposes, as outlined in this policy.
- Implied Consent: Consent that is inferred through actions, such as not opting out by obtaining a wristband or sticker at an event, indicating permission for photography or video recording.
- Explicit Consent: A clear and informed agreement provided in writing or verbally (where appropriate) by a parent/guardian for the capture and use of their child’s image or video.
- Sensitive Content: Images or videos depicting children in vulnerable situations or contexts that may be distressing or compromising to the child's dignity and privacy.
Roles and Responsibilities
CRQ Staff, Contractors and Volunteers
- Ensure compliance with consent policy and wristband/sticker system.
- Distribute and collect consent forms for small events.
- Monitor photography and video to respect non-consenting individuals.
- Ensure appropriate use of images and recordings.
Photographers and Videographers
- Follow consent guidelines, respecting wristband/sticker system.
- Capture images respectfully and avoid personal information.
- Use images only for approved purposes.
Parents/Guardians
- Obtain wristband/sticker if opting out of consent.
- Sign consent forms for small events.
- Communicate any concerns about image use.
Event Organisers
- Ensure clear consent information in registration.
- Oversee wristband/sticker distribution and form collection.
- Monitor responsible use of photography during events.
Funders and Sponsors
- Use images for agreed purposes, following CRQ’s policies.
- Notify CRQ of any concerns with image use.
By following these roles, CRQ ensures the respectful and secure use of children's images.
Policy Statement
For Events with Over 50 Attendees:
- Implied Consent through Registration:
For larger events (over 50 attendees) where photography or video recording may occur, CRQ will use a wristband or sticker system to manage consent.
- Parents or guardians who do not consent to their child being photographed or recorded must obtain a clearly identifiable wristband or sticker from CRQ upon entry.
- The wristband or sticker must be worn for the duration of the event to help photographers identify individuals without consent.
- This process will be highlighted during online or in-person event registration.
- Not obtaining or wearing the wristband or sticker will be considered implied consent, and CRQ may use images or recordings captured at the event in accordance with its policies. These images may also be shared with CRQ’s funders or sponsors for use in materials related to the event or initiative.
For Events with Fewer Than 50 Attendees:
- Written Consent Required:
At smaller events (under 50 attendees), CRQ will provide a standard written consent form to parents or guardians prior to capturing any images or videos.- The form will clearly outline the intended purposes for which the images may be used, including educational, promotional, or awareness-building activities related to CRQ’s work, as well as for use by CRQ’s funders or sponsors.
- Parents or guardians must sign the consent form to grant permission for photography or video recording.
Image Ownership and Use
The images and recordings may be used for promotional purposes, including but not limited to social media, websites, and print materials. All photos and videos taken during the event are the property of Children's Rights Queensland. Attendees do not have rights to these images, but they may request access for personal use. Children's Rights Queensland is not responsible for photos or videos taken by other attendees or third parties during the event and is not liable for any claims, demands, or causes of action arising from the use of event photos or videos. There will be no compensation for the use of any photos or videos taken during the event, whether used for promotional purposes or otherwise.
Verbal Agreement from Children
In addition to parental/guardian consent, CRQ may request verbal agreement from children to be photographed or recorded, where appropriate based on the child’s age, maturity, and understanding.
- Verbal agreement is particularly encouraged in informal settings to respect the child’s autonomy and comfort.
- However, verbal agreement does not replace the requirement for written parental/guardian consent.
Sensitive Content
CRQ will not use images depicting children in vulnerable situations or of a sensitive nature unless explicit written consent has been obtained. In such cases, CRQ will ensure the child’s dignity and privacy are fully respected.
Storage and Security of Forms
All consent forms and related documents will be securely stored, either physically or digitally, to ensure the privacy and security of the information provided by parents, guardians, and children. Only authorised CRQ personnel will have access to these records.
Revocation of Consent
Parents or guardians may withdraw consent at any time by submitting a written request to CRQ. Upon receipt, CRQ will take reasonable steps to cease further use of the images but may not be able to retract their use in materials already published.
By including children’s verbal agreement and ensuring parental or guardian consent is obtained, CRQ is committed to promoting the safe, respectful, and ethical use of media while upholding the rights and dignity of all children involved. CRQ also ensures the secure handling of all consent records.
Breaches of this policy
Non-compliance with this policy by anyone may result in investigations, corrective actions, disciplinary measures (e.g., warnings or termination), or reporting to relevant authorities. Breaches must be reported promptly to a member of the Children’s Rights Alliance Leadership Team.

Policy Status and Review
- Approval: Approved by the Child Rights Alliance Inc. Leadership Team.
- Review: This policy will be reviewed every two years. Feedback from children, families, and stakeholders will guide updates.
